Article 3 – Applicability
These Terms & Conditions apply to every offer made by Joe & Ivy and to every agreement concluded between the merchant and the consumer.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Any invalid provision shall be replaced with one that most closely reflects the original intent.
Article 4 – Offers

Obvious errors or pricing mistakes are not binding
Unless otherwise stated:

Prices may exclude import duties, customs fees, and VAT

These costs are the responsibility of the customer upon delivery
Article 5 – Agreement
An agreement is concluded when:

The consumer accepts the offer, and

Payment is successfully completed
We reserve the right to refuse, cancel, or limit any order if necessary, including in cases of suspected fraud or incorrect pricing.
Article 6 – Right of Withdrawal
Consumers have the right to withdraw from the agreement within 30 days of receiving the product, without providing a reason.
Conditions:

Products must be returned unused and in original packaging

The consumer must notify us within the withdrawal period

Returns must comply with our Return & Refund Policy
Failure to meet these conditions may result in rejection of the return.
Article 7 – Costs of Withdrawal

Return shipping costs are borne by the consumer

Refunds are processed within 30 days after approval

Refunds are issued to the original payment method
Article 8 – Exclusions
The right of withdrawal does not apply to:

Hygiene-sensitive products (e.g. underwear, lingerie)

Personalized or custom-made items

Products that cannot be returned due to their nature

Opened or used items that are no longer in resale condition

We are not liable for typographical or pricing errors.
Article 10 – Conformity and Warranty

The warranty does not apply if:

The product has been misused or damaged by the consumer

Unauthorized repairs or modifications have been made

Damage results from improper handling
Article 11 – Delivery and Performance

Orders are processed and shipped within the stated timeframes

Delivery times are estimates and not guaranteed

Delays may occur due to external factors beyond our control
If an order cannot be fulfilled, we will notify the consumer and offer an appropriate solution.
Risk of loss or damage transfers to the consumer upon delivery.

All payments must be completed at checkout using our secure, SSL-encrypted system.

Our liability is limited to the purchase value of the product.
Article 15 – Disputes
All agreements between the merchant and the consumer are governed exclusively by South African law, regardless of the consumer’s location.
